Since an adequate didactic level is substantially based on the research activity, the Council of the Faculty of Law developed the following research lines for Professors and Researchers, based on the respective scientific interests:
a) Public Law: Multilevel Governance and Principle of Subsidiarity;
b) Private Law: Contract Law and Protection of Consumer;
c) International Law: the Fundamental Rights of Aliens.
In particular:
- The main research areas of Constitutional Law and Comparative Public Law concern the multilevel governance and the principle of subsidiarity in its theoretical, normative and jurisprudential evolution in Italy and in the European Union; in addition with regards to the comparative sector the research is focused on the running processes of federation and devolution with particular attention to the Italian, German and Austrian experiences. The goal of this analysis is to bring to light the progressive lines of these phenomena, underlined by the constitutional reforms and by the jurisprudence of the constitutional Courts.
- The research activity concerning “Private Law” area is focused on the evolution of contract law and consumer law, in the international perspective of enterprises. The current national regulation of consumer contract (in Italy, as well as in the very majority of European Union member states) is affected by need of multidisciplinary and ongoing updating: also for purpose of implementation of the EU Directives on consumers’ law, and via the increasing EU common framework of criminal and administrative sanctions targeted against crimes in the Internet. The research activity in this area is aimed at analyzing the interaction between national private law and European Union law, as well as at providing an overview on the changing regulatory framework, with a focus on recent case-law by European Court of Justice. - Within the sectors of International law and European Union Law the research activities of the Law Faculty at present times are focused on the limits to expulsion of aliens and the enjoyment of fundamental rights in the context of expulsion. In particular, the scope of the inquiry concerns, at the European level, the European Convention on Human Rights and the European Union legislation in the field of visa, asylum and migration and, at the international level, the works of the International Law Commission on the subject “Expulsion of aliens”.
While taking into account that research activities produce results in the medium and long-term period, the research efforts made so far by the Professors and Researchers of the Law Faculty are very satisfying. In particular, the telematic functionality of the University has allowed to counter the scarce quantity of the paper library, with the resort to virtual libraries which nowadays are widely accessible. This has also stimulated the cooperation with other university in research activities, even beyond national borders.
